INFORMATION ON THE PROCESSING OF PERSONAL DATA PURSUANT TO EU REGULATION 2016/679 (GDPR) AND NATIONAL LAWS IN FORCE (Legislative Decree 196/2003, as amended by Legislative Decree 101/2018)
We inform you that your personal data will be processed by the Data Controller, PUGLIA VILLAGE: Fashion District Molfetta S.r.l., which can be contacted at the email address privacy@lof.it and is hereinafter referred to as “the Controller”, with registered office in Via Cordusio, 1 – 20123 MILANO – fdmolfettasrl@legalmail.it. Personal data is information relating to an identified or identifiable natural person (“data subject”). "Processing" involves operations carried out with IT tools or on paper for the purpose of (by way of example but not limited to) collecting, organising and retaining personal data.
In compliance with the aforementioned European and national legislation, the Data Controller has put appropriate technical and organisational measures in place to guarantee data protection and has also identified and appointed Inprivacy Srl as Data Protection Officer (RDP or DPO), which can be contacted for these purposes at the e-mail address: info@inprivacy.it.
What personal data we process
We process non-sensitive personal data – personal identification and/or contact details, including first name*, surname*, date of birth*, email address*, password* and membership card number* (marked with an asterisk* because they are required by the Data Controller for the purpose of checking their uniqueness and correct processing), plus gender, telephone number, postcode, country, province (for Italy only), address, other villages of interest, family composition and store categories of interest – in the case of personalisation of the chosen service with preferences; we process personal images captured in the form of photos and/or videos in the case of express authorisation for specific purposes; and we process IP addresses and usernames in the case of browsing on the website or connecting to the Wi-Fi network.
Why we process them (legal basis and purpose)
We process this data to promote the business activities of the Data Controller based on commercial offers specifically requested by the data subject, and in this case the legal basis of the processing will be the need to execute a contract to which the data subject is a party or to implement pre-contractual measures adopted at the request of same (Article 6, paragraph 1, letter b, GDPR). In the case of photographs and/or video recordings, and also the sending of commercial communications and/or profiling for promotional purposes, the legal basis will be consent (Article 6 paragraph 1, letter a, GDPR).
Consequences of failure to provide data
The provision of such data is optional, but in the event of refusal to provide the data required by the chosen service (data items marked with an asterisk*), the Data Controller will not be able to carry out the aforementioned activities (e.g. it will not be possible to browse the website, connect to the Wi-Fi network, publish photos on social networks, benefit from gifts or discounts reserved for loyal customers, or participate in promotional events for which processing is essential because registration for the Village Card is needed).
Communication and dissemination
The aforementioned personal data will be processed in paper and electronic form and will be disclosed only in the event of specific consent (in this case by means of the publication of images referring to voluntary participation in promotional initiatives). The data may also be processed by internal staff authorised and/or designated by the Data Controller and communicated to the parties who are needed to perform related activities. Such staff act as Data Processors pursuant to writtenagreements with the Data Controller and/or to specific agreements with other parties that are functional to processing by the Data Controller.
Retention periods
Based on what we reasonably believe to be your expectations, the data will be retained until you withdraw your consent, and in any case no longer than 10 years, without prejudice to the possibility of renewing your consent under the same terms. Please note, however, that photos and videos published on the website may be downloaded and saved by third parties. Any withdrawal of consent will therefore require the Data Controller to delete such photos and videos from its channels but does not guarantee that any copies saved by third parties will also be deleted.
What are your privacy rights and who should you contact
In relation to the aforementioned processing operations, the data subject can exercise all the rights referred to in articles 15-22 of the 2016/679 European Regulation (including access, correction, deletion, restriction, objection and portability, where this does not conflict with the law or with contractual obligations and is technically possible) by sending an email to the Data Controller at privacy@lof.it, by contacting the DPO, or by written communication addressed to the headquarters of each Village.
There is also always the option of lodging a complaint with the Supervisory Authority www.garanteprivacy.it.
With reference to the processing of personal data based on consent, the data subject has the right to withdraw such consent at any time, without prejudice to the lawfulness of processing based on the consent given before withdrawal.
